introduce wasted costs orders for malicious or frivolous prosecutions

Consideration should be given to making wasted costs orders against police officers, CPS lawyers and prosecutors to be paid by them personally when they bring malicious or frivolous or vexatious prosecutions against members of the public.


This provision is already available in civil cases. Where malice has clearly been shown the people responsible for bringing such prosecutions should not be permitted to hide behind privilege.

Why does this matter?

It would save time, money and resources, and would discourage malicious prosecutions.
