Limit legal costs of both sides of a case to the same money

Comment 28th July 2010

Each side of a court case should only be allowed to spend the same money on their lawyers. If one side particularly wished to increase their legal defence/procesution then then they should foot the bill for the opposing party so that the costs are identical

Why does this matter?

The current legal system is no democracy at all. The party with the most money to spend on lawyers frequently wins. In addition, the legal system itself is currently used as a tool by companies to bankrupt smaller companies by protracted and complex legal proceedings. Mostly if it's a small company against a big one the smaller company is forced to either spend huge amounts of their capital in relation to their size, or capitulate.

Either the above suggestion or the state should pay all legal costs always, it may force them to think about the complexity of the current legal system.
