The Crown Prosecution Service, Department of Health and Pharamcy bodies must work together to remove the threat of criminal conviction if an inadvertent dispensing error is made.
Why does this idea matter?
Current legislation makes it a criminal offence if a pharmacist or technician inadvertently makes a dispensing error. This cannot be correct for inadvertent mistakes and is not the case for other health professionals including GPs.
Guidance has been promised on this issue, but when released did not help the profession.
I imagine that this leads to under-reporting of errors since by reporting a mistake you are confirming that you broke the law. This must lead to important lessons not being learnt.
