Reducing legal costs

Legal costs awarded against the losing party should not exceed their own legal costs.

Why does this matter?

A person with limited resources would be able to fight a court case knowing that even if they were disadvantaged by the other party employing the highest paid QC in the country, at least they would not have to pay his fee if they lost.

   This would have the effect of driving down legal costs and legal aid costs.
