This idea is very simple but very powerful, and is to allow judges to dismiss a case on the grounds that the prosecution has come about as an unintended consequence of a law.  In their haste to rush through as many laws as possible, the previous Labour Government has left us a legacy of badly drafted legislation which makes it far too easy for innocent and unwary citizens to become victims of laws that were intended to prevent terrorism, illegal immigration and anti-social behaviour.  

Why is this idea important?

This will prevent Police, Local Authorities and other bodies from using laws for purposes other than their original intention thereby safeguarding individual liberty and preventing the legal system from being bought into disrepute.  Contrary to what the tabloid press would have us believe, our judiciary are sensible and intelligent people who are more than capable of assessing the intention and spirit of the law.
