The idea

The Transfer of Undertakings (Protection of Employment) Regulations were based on sound principles, but are now extremely restrictive and costly for organisations taking on contracts from existing organisations – particularly the public sector. 

Why is it important?

The financial and time costs for private and particularly third sector organisations involved in taking over public sector contracts restricts both competition and the ability of new providers to improve service delivery to the extent that they could.  The situation with regard to public sector pension provision (Cabinet Code of Practice/Government Actuaries Department comparability test) is particularly prohibitive.
