My idea is important because this absence of common sense is bringing the law into disrepute.
We should restore an element of common sense into our legal system. It used to be there – lawyers talked about "The man on the Clapham omnibus", as representing the common sense of the ordinary British person. I don't know whether police, judges and magistrates are losing there sense of proportion, or whether they are acting under orders. Here are three examples from thousands that show where our legal system has lost its way.
A burglar falls through a skylight and succesfully sues the owner of the building.
Two small boys who may or may not have inappropriately touched a small girl are put on the sex offenders register.
Inmates of HMP are able to claim that access to pornography is part of their human rights.
