Removal of Parental Responsibilty for Long term Prisoners

Civil liberties gone mad, in the eyes of the law no matter what you do you will unless your child is put up for adoption have responsibilty for your child.

This means you can abuse children be prosecuted and still have parental responsibilty, you can murder somebody, rape somebody and god knows what else but it would never be removed.

This means a child or a partner who has endured years of abuse still has to seek permission to take there child out of the country by somebody who is in prison, the only steps you can have put in place are no contact orders and prohibitive steps order, even then if you were to leave the country for longer than a month you would have to still seek permission from the other parent who could be more of a danger to the childs well being.

Your liberties are taken away when you goto prison and i feel if it is a long term sentence parental responsibility should be removed especially if the imprisoned parent is not released until after the child is of adult age.

Why is this idea important?

Children’s training by their parents

Dear Sirs

I think the law of taking parents away by police and lock them up when they try to teach their kids to make them behave and trying to teach them way of life to live in society should be looked into (REMOVED)

An economic liberty: nationalise the Christian Brothers & liquidate

This is an idea for economic liberty rather than legal, so it is slightly off the invited topic.

I note that the Christian Brothers have stated that they will only co-operate with a government enquiry (not the UK government but the same sort of thing in Eire) if complete anonymoty is guarenteed.

At such a point in proceedings, I suggest it is time to nationalise UK assets of the organisation, liquidate those parts which serve no popular purpose to the mainstream of the population, and donate the takings to a trust fund to support those who have suffered from such organistions.

Simples.

Fewer rights for convicted child abusers

I would like to see a system in place whereby people convicted of serious crimes against children – for example Karen Matthews and the three adults involved in the death of Baby Peter – are sterilised upon conviction. They have had children, abused those children and should therefore forfeit the right to have any more. Too often in these cases, the authorities are vilified by the media and the public (let's blame social services, the police, the school etc) and we overlook that the parents or guardians of these children are ultimately responsible for the crime. Let's learn from our mistakes by all means, and improve our procedures and systems, but let's also never ever give people the chance to put another child through this.

Overturn unfair criteria of Criminal Injuries Board

As it stands in familial sexual abuse cases, if  the injury or sexual assault happened before October 1 1979 and you were living with that person as a member of their family, you are not entitled to claim.

This is a complete travesty of justice. How can a child who suffered sexual abuse on 30 Sept 1979 be any less deserving than a child who suffered 1 day later.

The child would in most cases have had no choice whatsoever as to whether they lived in the same house as their abuser.

Overturn this barbaric rule. There should be retrospective awards to cover all bases.

Speed Limits – Restore The 85th Percentile Rule

Speed limits used to be set at the speed below which 85% of drivers would choose to drive, measured in free flowing traffic.  This is a proven scientific formula which set limits at a sensible level.  This ensured that only the reckless few were prosecuted.  The last government changed this to the 'mean speed' meaning that councils can set limits making 50% of drivers criminals.

This should be reversed.  Then all the argments about speed cameras and punishments would becoime superfluous as responsible drivers would not be criminalised.

Education to prevent Paedophilia

I think that the Religious Education in schools should be replaced with a subject that educates children from day one about paedophilia so that they recognise it and know what to do if they experience paedophilia. Paedophilia is more common than society realises (remember, sex-offenders do keep it secret) and defenseless little people are being hurt because they are naive enough to believe that, for instance, 'all daddies do this to their children' and dont say anything. If they were educated about this, they would be able to put an end to it before it begins. This is not unrealistic at all, it is not costly, it does not disrupt the national curriculum, it is useful in a realistic world rather than a load of make-believe. It is simple plus think of the effectiveness of it.

repeal restrictions on parental rights

All parents should be allowed to correct their children's bad behaviour at home, this should include corporal punishment but be limited to caning, smacking and the with drawl of pocket money/going out during certain hours of the day.

The use of corporal punishment should also be allowed in the school (head teachers/ head master/mistress for insubordination/ unruly behaviour/violence.

One CRB check to cover all organisation, eliminate need for one act of volunteering and replace with references for some categories of people

Currently it is neccessary to have a CRB check for each organisation you volunteer for. It is a disincentive.  Make one CRB check cover all organisations even if it needs to be more comrehensive initially. Eliminate the need for a CRB check where the volunteer is only going to volunteer once for a few hours.  Consider whether in some cases references could take the place of checks.

Stop Mothers divorcing their children from Fathers and Grandparents.

It is now well known in the Western world that most custodial parents of divorced children cause these children to have Parental Alienation Syndrome.  It is so well known that books have been written about it you can buy on Amazon.  It is well known that 50% of children lose touch with their absent parent after divorce.  What is not realised is why these children become divorced.  Their mothers use various tactics which, even when the Courts recognise it, nothing is done about this child abuse.  Judges will threaten the mother with jail when they redefine access for the umpteenth time but they will never carry out their threat as it would show up the Court's bad custody decision.  Make it mandatory on Judges that, if they see this child abuse, often shown by having the absent parent applying to redefine access which is breaking down frequently, then the Judges must jail the Mother (who it usually is) and turn over custody to the Father, with no judicial leeway whatsoever.

Read about it from the report by Stan Hayward at www.coeffic.demon.co.uk/pas.htm

Parrental Alienation Syndrome IS child abuse!

It is written in the Children Act 1989 that the claim of the Father is equal to the claim of the mother.  Since the OPEC countries hiked up the price of fuel; and therefore energy in general, in the late 1970's, most people know that you can no longer run a family on one parent as the wage earner.  Most families need both parents to work.  This is reflected in the 1989 Children Act.  However the Courts still, decades later, think that it is still the 1960's and award residence orders on the basis that it is the Father's role to be the breadwinner.  In the 21st century this is not true, with many wives earning more than the husband.  Yet still residence orders 91% are given to the mother.  It has moved towards reality by only a few percentage points – from 97% in the 1980's.

Clearly the Family Courts are blatently flouting the Statutory Law that the claim of the Father is equal to that of the Mother.

Once a child is off the breast there is nothing that a Mother can give that child that the Father cannot do better,  I make this claim on the basis that a Father's parenting is more CONSISTENT from day to day than most mothers' parenting, possibly because they are women whose oestrus cycle makes them feel different each day.

Most problems with young people and adults, whether in education or prison or probation services, are caused by inconsistent parenting.  I am a secondary teacher and see it every day.

I was a Registered Childminder for twelve years and none of the 250 children I brought up for other people ended up in the criminal justice system.  I taught parenting to dysfunctional families for Social Services during that time.  I was head hunted as a consultant to Suffolk Social Services to encourage men into primary care.  I was headhunted by the Probation Service too.

Forcing Judges in the Family Courts to obey Statutory Law as outlined above would have far reaching effects to the benefit of our society, see below.  This could possibly be done by sacking them if their results for residence orders are not within a few percentage points of 50%.  Full accountability!

Only then would our children recieve their statutory right to be brought up by the better parent.

Outlaw corporal punishment in the household.

We are one of the many countries who have outlawed men physically abusing woman as a form of punishment. Therefore, the situation with corporal punishment in the household has improved recently. However, there is one family memeber in the household we have forgotten. The most vulnerable in society, the one without a voice: the child.
Discipline is essential during the upbrining of children. It shows them the difference between right and wrong. However, many parents take punishment a little too far. Children who are physically punished are more likely to become egocentric and antisocial throughout and after their childhood.

My idea is to outlaw the smacking of children. This is now the 21st century, the true harm of physical punishment towards children has been revealed just as the true harm of violence between spouses has. Yes, many children don't know the difference between right and wrong. However, they also don't know the difference between a "reasonable chastisement" and abuse. Why should we open the gate for abusive, drunk, or drug-abusing parents to beat their child just to allow an old-fasioned, degrading, dangerous and ineffective method of discipline to remain legitimite?

CRB

Remove the use of CRB checks for parents that help out on school trips etc. Keep them for parents that will have lone contact with children where a teacher is not present, eg running an after school club or helping with one on one reading. Not for a day trips, PTA events etc where there is a crowd of people and it would be impossible for anything to happen.

Bring back the power to discipline proportionally instead of idiotically

for too many years people have had there right to discipline children systematically stripped away, this started with the removal of corporal punishment options in magistrates courts, next was the removal of a policeman’s right to decide should he give someone a clip round the ear of fill out 2 hours worth of paperwork, at the same time schools became unable to enforce discipline in the same way they had done for generations past, and then finally parents lost the right to meat out punishments as required.

The results as we can see now across society are that we now have swaths of young people with no idea or concern of consequence for actions they undertake, we see ridiculous asbo's and pointless court orders that do nothing to stem the tide.
