Killing a pheasant by car on road

If someone driving accidently kills a pheasant on the road, I understand that the person behind in the following car can claim it but not the driver who killed it.  If this is so, then this is nonsense.

Needs to be repealed.

Why does this matter?

Pheasants are large birds which do damage to vehicles.  For this, at least the ability to eat what you accidently killed should be your right, not for the person behind who suffered no damage to their vehicles.

    But if the Pheasant damages your car whose fault is it?? The pheasant was obviously put there as shooting stock, so should the game keeper be charged with not keeping his animals under control like cows or sheep??
