Children should be cut loose from immigration knots

Any immigrant invariably of their immigration status, if they have dependent children above 5 years of age who are attending school should be the matter of concern to immigration authorities trying to implement harsh rules on their parents because indirectly the pressure of parents will have an effect on the children as well. For what fault of theirs are they being made alienated from the land they were born and broughtup. They know of only whats happening now and to leave a scar in their hearts at that tender age is impermittable. Govt. must change the scenario and do justice to young hearts out there playing merrily with their pals not knowing the authorities are to detour their fate any time as they wish.

Cheating UK

All the Indian it companies are bringing alot of professionals on intercompany transfers to UK.

1.they only pay allowance to them but in their work permit they show income nearer to 40k at the time of visa application,but they will not pay taxes to gov of UK

3.if a guy comes on TCS intercompany transfer and works for one company in UK for 3 months then TCS is using the same person in another company for some other time.All the it companies are using intercompany transfer as tier1

I am very pleased that when reading the other comments I see that none of them can be classed as racist. only a genuin concern for the amount of people that have been allowed to settle here my own feelings are that if a person has left his or her family behind in a so called violent country they should be sent back .I believe that most immigrants  are men  why are they not in their own countrys trying to help make things better. any illegal person caught entering this country should lose the right to claim asylum and should be deported straight away. without the right to appeal I do believe that some of these people cross 3 4 5 countries to get here are we to believe that the other countries they pass through  will not help them .  stop giving our hard earned money to them in benifits hand out food tokens not cash .and just maybe the people that  work might feel less angry at how their money is used  we will always help protect the weaker countries if we can . but for now  until we can sort ourselves out  it must be that old saying  charity  begins at home even the people born and bred here are being refused help  so how can we keep taking  more and more  people in

Immigration Rules should protect indigenous citizens!

I am a 71 year old indigenous citizen of the UK and an old age pensioner. I was widowed in 2002, and met and married a Russian widow in 2004 who was living in this country. I have a 27 year old stepson who has been receiving our financial support since we sent him back to Russia six years ago having been brought into the UK illegally by his elder brother when a 17 year old shortly after the death of their natural father.We have been trying to get the young man back to the UK to live with me and his mother as our dependant (and with NO resorting to welfare benefits) for the last three years trying to use the legal channels – i.e. visa applications etc.. It has all been a waste of time and cost a lot of money from my pensions!Attending immigration appeal tribunals is like being in a foreign country, with NO participant with any understanding of my own indigenous culture!

The Immigration rules as they are today were never meant by the legislature to break up the families of genuine indigenous citizens who marry foreigners and take on the family commitments associated with such a covenant. Their real reasons were to prevent mass colonisation of the UK by foreign families particularly from past  'Empire' states in Africa and Asia. However, in order to be 'just in a democratic society', the rules are applied to an indigenous citizen equally with no discrimination, despite the fact that the non-indigenous citizen does have a choice of domicile, usually another continent with definitely better weather! In all the New World countries, laws are passed which DO discriminate in favour of indigenous citizens where appropriate. Examples of this can be seen in the whole of the North and South American continents as well as Australia and New Zealand. 

Presently I am living in another European state and I have residential status there. I have abandoned my fully paid up home – except, of course I must still pay the Council Tax etc.., and I have rented a small apartment. The reason for this is that in other parts of the EU they are not so strict with their immigration rules and DO have such things in their statutes as 'Family Visit' or 'Family Re-unification' visas which permit family members to visit without the Gestapo techniques and prejudices visited on us by the UK Home Office. I have even taken up my Irish nationality(my father being born there), as I feel so strongly against the UK after over six years of battling with the Home Office, firstly with my wife, who was deported 6 months after our marriage, and then trying to get our son back to live with us. My wife has jumped through all the new hoops and is now a naturalise UK citizen! She is 55.

The Immigration Laws need to recognise that an indigenous citizen marrying a foreigner has the right to live in peace in his own country with his, albeit new, family without interference by the state. This is, after all, an Article 8 of the ECHR directive, and is, sadly, broken continuously by the UK Home Office.

The present set of PSW visa holders are unfairly trapped by the new increase in points to attain the tier 1 visa. When we took out the post study, we knew how much was required to be able to switch.

To be fair, I feel that present PSW visa holders should get at least 15 points.

The average salary for a graduate job in the UK is £25000. I require a £50000 salary to qualify under new rules. When I applied for the PSW visa, I needed far far less than that.

Is it not a civil liberty to have freedom of speach and celebrate our countries customs without having to worry the local council is going to accuse us of being racist?

If we want to celebrate customs such as Easter and say we are English it is OUR right as British people. Surely the government should stop councils from offending the British by stopping them having that freedom? I was disgusted at the amount of councils last year that stopped putting up christmas decorations because it will offend. It offends us if they are not up.

The government needs to put some sort of guideline in place so that EVERYONE is happy not one or the other. At the end of the day we ALL live here and NOONES customs should be stopped or curbed. After all i thought we were a nation of EQUALITY.

Solve some of the problems

Scrap (temporarily) immigration until work is available for all U.K. born (& 2nd generation)

Provide work for all 16 year old and above and scrap ALL benefits, saving enormous amounts in Admin. costs EXCEPT for Military injured on active service, who should automatically be given Blue Badges (Disabled Drivers) or free travel, ALL Hospital Treatment and Medication also free.

Jobs to be createdwhere neccessary for disabled (e.g. Toilet Attendants, Car Park Attendants, Lift Men/Women, Cal Centre Operators etc etc

ALL transport to be electric wherever possible to cut cost of Oil imports

All Defence spending to be in U.K. ONLY: thus no dependance on parts from another country, jobs for u.k. citizens no outflow of cash to pay for Americal, Canadian etc products

ALL operations owned by overseas interests (e.g. Anglian Water: France: Electricite de France, France Telecom, Santander, Telefonica, Deutsche Telecom etc) so that we are not held to ransom by external influences.

Encourage ALL  development of electrically powered items to replace any item using imported fuel. (Think WW2 convoys – if it had to be brought in by convoy substitute a home grown item) and havingdeveloped the electrical power unit EXPORT, EXPORT, EXPORT

Finally ensure NO building work granted permission unless green and ecologically sound

AND ALL rules/laws RIGIDLY enforced by Policing policies under close Governmental scrutiny

As so many of our own children are now leaving school, college and university and cannot get work at all. I would like to suggest that all uk companies be required to employ at least 70% British and 30% others. All companies with jobs in the UK should be supporting our economy this would get our young people into employment and reduce the numbers on benifits from families that have worked and paid into the system,  Foreign students/ exchange yrs students should not be taking all the UK  service industry jobs.

having watched a 'UK border patrol' programme I can't help feeling that the law on immigration is topsy tervy. If we are informed correctly then immigrants, who have over stayed their visit or are working when they shouldn't be, and cannot produce a valid passport are allowed to stay in the UK whilst those who commit the same offence but can produce a passport are deported. Surely anyone who enters the UK and then cannot produce a passport should be automatically deported?

having watched a 'UK border patrol' programme I can't help feeling that the law on immigration is topsy tervy. If we are informed correctly then immigrants, who have over stayed their visit or are working when they shouldn't be, and cannot produce a valid passport are allowed to stay in the UK whilst those who commit the same offence but can produce a passport are deported. Surely anyone who enters the UK and then cannot produce a passport should be automatically deported?

Amend Part 3 of The Immigration (EEA) Regulations 2006 so that residence cards compliant with Article 10 of Directive 2004/38/EC are issued to  non-EEA spouses/civil partners of uK citizens when they are issued with UK identity cards and are granted leave to remain in the UK. The issue in particular should include non-EEA spouses/partners originating form countries listed in Council Regulation (EC) No 539/2001.

Being over 50 I am aware of the discrimation in the work place.  I have applied for hundreds of jobs but have only had two interviews. I saw an article in the "Daily Mail" yesterday regarding the over 50s who are highly skilled and looking for a job, but are unable to find one. The other side of the coin is the CBI telling everyone that this country has a skills shortage, and skilled people need to be let into the UK from outside of the European Union. This Is just an Idea to help solve both problems. Start a website where all the unemployed people could register their skills and C.V.  If an employer applies to the government saying, "I can't find the skills I want and need to bring people in from overseas"; they could  then be directed to this website and, with a little joined up thinking, the employer would find the skilled worker he needs and someone would get a job. If the employers still say  no one was suitable, they could be challenged.

If an employer applies to the government saying "I can't find the skills I want and need to bring people in from overseas" They could be directed to this website and with a little joined up thinking the employer would find the skills he needs, and someone would get a job. If the employers still says that there is no one suitable they could be challenged.

New English language requirement for partners

From 29 November 2010, you will need to show that you can speak and understand English if you want to enter or remain in the UK as the partner of a British citizen or a person settled here.

I wish to change the new requirement so a person does not need to pass any test before any  power so that they may live there life together.

Attracting the best & brightest minds to UK

My idea is to to make UK the destination of choice for pursuing Higher education(Post graduate studies and Phd) especially in the fields of science and engineering to student around the world.Thereby having promoting high quality research which should eventually lead to innovation and perhaps birth of new generation of British companies.

There has been a lot of talk about capping immigration from Non-EU Nations.But if closely analyze most of the immigration coming from Non-EU nations are generally highly skilled personnels such as engineers and doctors especially from South Asia.At same time if you analyze the immigrants from EU nations they generally are low skilled labour.

In this era of increased globalization due to low cost of labour present in countries like China and India most of the low skilled jobs will move to these countries.The only way Britain can improve its economy is by innovating especially in the fields of engineering& science.This countries like Britain,Germany and US have the key.I am from actually India where research is usually never encouraged and funds are very difficult to get . Moreover we don't have the facilities to conduct world class research. Many engineering graduates in India actually tend to go for higher studies in US instead of UK because of funding available.The ones coming to UK are not so brilliant ones who couldn't get into a good US universities.

But if you want to change this and attract the best student to your universities you will need to do two things.First make it easy for Non-EU students to work in Britain who have done their masters or Phd in British Universities.Second Make it easy for international students to get studentship and funding in Britain.

My idea revolves around the first.The post study visa which is of 2 year duration currently enforce is not much of use because you cannot extend the visa or convert into Tier 1 visa by yourself.The companies are reluctant to support you for Tier 1 visa due to the procedures and cost.They expect you to convert you immigration status to one where they can hire you directly.

My idea is make the post study  visa of 3yrs duration and convertible to Tier 1.Provided the candidate can show that he has worked in an engineering/science related job in Britain for at least 2 years out of those 3yrs.And other conditions such as he completed his post graduate education/Phd in a British university.This will not hamper British undergraduate prospects in UK as the post study work visa will be eligible to post graduate students.I must add very few British students actually pursue post graduate studies in Engineering/Science fields.

Secondly make it easy for international students to get Fully funded studentships and funds for research.This will encourage them to do research and innovate which will eventually help fuel the British economy.If you take this idea seriously and implement it you will get the cream of determined international students to do high quality research and replace US  as destination of choice for post graduate studies in the field of engineering/Science.I personally love to come and do research in an UK university.

Apply time limits and judicial oversight to immigration detainees

 

At present the decision to detain someone is made by an immigration officer without any judicial oversight. There is no time limit on immigration detention, and detainees have great difficulty getting legal representation to apply for bail. Thus their access to a legal challenge to the deprivation of liberty is severely restricted. While the UK Border Agency(UKBA) claim that no-one is detained for ‘longer than is necessary’, there is no legal limit on detention.  Figures from the Home Office in February 2010 showed that 255 people had been held in immigration detention for more than a year in 2009 – and 45 for more than two years. In reality, since UKBA keeps no figures on cumulative detention, more people have been detained for longer than the figures suggest.  The Home Office has the power to detain someone either to examine their asylum claim if they deem that claim to be straightforward, or if they believe the person will abscond, or that their removal from the UK is imminent.In practice, for many detainees there are barriers to their removal, such as lack of documentation, or the destination country being unsafe, which means that hundreds of people are held for long periods without prospect of release.  There are just over 2500 detention spaces.

The mental toll of indefinite detention is manifested in many ways, not least in the amount of self-harming incidents among those held. In 2009, 215 people needed medical treatment for self-inflicted injuries, a rise of 20 per cent on 2008, according to Home Office statistics.

The First Tier Tribunal of the Immigration and Asylum Chamber (currently operated separately from HM Court Services) often require a lower burden of proof from the Home Office than from the applicant. If the HO claims that a person will abscond no evidence is required. Immigration detainees have great difficulty securing release from detention through the courts.  Just 18% of applications for bail are successful.  Although under the law there is a presumption in favour of liberty, in practice many immigration judges put the emphasis on the detainee to prove why he or she should be released from detention, rather than placing the burden of proof on the Home Office to provide evidence as to why the deprivation of liberty is deemed necessary.

There are no written records of bail hearings.  Only the judge’s decision is recorded so it is impossible to provide evidence of errors or of the basis on which decision are made for future challenges.
